    Background
      What is HIPAA?
      On April 14, 2003 the Privacy Rule of the Health Insurance Portability and Accountability Act (HIPAA) went into effect. Developed, released, and enforced by the Department of Health and Human Services, the HIPAA Privacy Rule sets national standards for maintaining the privacy and enhancing the security of an individual's Protected Health Information (PHI).
      Protected Health Information includes all "Individually Identifiable Health Information" (IIHI) that is in any type of format, either electronic or paper that is maintained, stored, or transmitted by a Covered Entity (CE).
        UMKC's acceptance of HIPAA responsibilities (December 2002).
      HIPAA affects UMKC Research, Institutional Research Boards (IRBs) and, in particular,
      patient care covered by the HIPAA Privacy Board of the School of Dentistry.
        HIPAA also directly affects patient care and research at affiliated institutions, Truman Medical Center, Children's Mercy Hospital and Saint Luke's Hospital.
          Research is defined in the Privacy Rule as "a systematic investigation, including research development, testing, and evaluation, designed to develop or contribute to generalizable knowledge."
      On April 21, 2003 the Security Rule that protects IIHI went into affect, summarized in a HIPAA Fact Sheet.

    Application to HIPAA Privacy Board (School of Dentistry)
    • The Principal Investigator (PI) of a research project is responsible for communicating, as appropriate, with both the Adult Health Sciences IRB and the Privacy Board.
        The chair of the School of Dentistry Privacy Board is John Purk (Email: PurkJ@umkc.edu).
    • To review any patient Protected Health Information (PHI)
        (e.g. screening UMKC School of Dentistry (SOD) patients' medical charts for information that will be collected and analyzed for publication)
      you need to obtain and submit by email to the HIPAA contact noted above:
      • an individual's Authorization or:
      • request a Waiver of Authorization from the School of Dentistry Privacy Board.
          Prepare and submit the approriate form:
        • Authorization form (Word)
        • Waiver of Authorization form (Word)
        • Request for Data Access in Preparation for Research (Word)
        • Data Use Agreement form (Word)
      Note: UMKC IRBs will not release IRB approval documents until appropriate HIPAA applications/approvals have been completed when the research involves certain affiliated institutions, such as the School of Dentistry.
